The decision to refuse an application for a waste facility at Orchard Hills has been overturned by the Land and Environment Court but stringent conditions on a challenging site where extractive industry and rehabilitation is required may prove the Dellara proposal financially unviable.
Since beginning the appeal, Dellara has gone into voluntary administration but the judgment has not been affected by this because the provisional approval has been granted for the actual site, rather than to any specific owner.
